Article 329: Consequences of bringing an action in bad faith or without justification

(1) A defendant acting in bad faith, or a party bringing an action despite having no right whatsoever, may be ordered to pay, in addition to the costs of proceedings, all or part of the attorney's fee agreed between the other party and its attorney. In the event of a dispute over the amount of the attorney's fee, or if the court finds the amount excessive, this amount shall be determined directly by the court.

(2) A defendant acting in bad faith, or a party bringing an action despite having no right whatsoever, may in addition be ordered to pay a disciplinary fine of five hundred Turkish Liras to five thousand Turkish Liras. If these situations were caused by the attorney, the disciplinary fine shall be imposed on the attorney.

MADDE 329 · Kötüniyetle veya haksız dava açılmasının sonuçları

(1) Kötüniyetli davalı veya hiçbir hakkı olmadığı hâlde dava açan taraf, yargılama giderlerinden başka, diğer tarafın vekiliyle aralarında kararlaştırılan vekâlet ücretinin tamamı veya bir kısmını ödemeye mahkûm edilebilir. Vekâlet ücretinin miktarı hakkında uyuşmazlık çıkması veya mahkemece miktarının fahiş bulunması hâlinde, bu miktar doğrudan mahkemece takdir olunur.

(2) Kötüniyet sahibi davalı veya hiçbir hakkı olmadığı hâlde dava açan taraf, bundan başka beşyüz Türk Lirasından beşbin Türk Lirasına kadar disiplin para cezası ile mahkûm edilebilir. Bu hâllere vekil sebebiyet vermiş ise disiplin para cezası vekil hakkında uygulanır.
