Part Eight: Legal Remedies › Chapter Three: Retrial
(1) The petition containing the request for retrial shall be examined by the court that rendered the decision.
(2) Depending on the nature of the ground relied upon, the court may require the person requesting the retrial to provide security in an appropriate amount to cover the loss and damage of the opposing party.

MADDE 378 · İnceleyecek mahkeme ve teminat
(1) Yargılamanın iadesi talebini içeren dilekçe, kararı veren mahkemece incelenir.
(2) Mahkeme, dayanılan sebebin niteliğine göre yargılamanın iadesi talebinde bulunandan karşı tarafın zarar ve ziyanını karşılayacak uygun bir miktar teminat göstermesini isteyebilir.
