Article 40: XV. Protection of fundamental rights and freedoms

PART TWO: FUNDAMENTAL RIGHTS AND DUTIES › CHAPTER TWO: Rights and Duties of the Individual

Everyone whose constitutional rights and freedoms have been violated has the right to request prompt access to the competent authorities.

Added paragraph: 3/10/2001, Law No. 4709, Art. 16 The State is obliged to indicate in its proceedings the legal remedies and authorities to which the persons concerned may apply, and the time limits for doing so.

Damages incurred by any person through unlawful acts of public officials shall also be compensated for by the State in accordance with the law. The State reserves the right of recourse to the official responsible.

MADDE 40 · XV. Temel hak ve hürriyetlerin korunması

Anayasa ile tanınmış hak ve hürriyetleri ihlal edilen herkes, yetkili makama geciktirilmeden başvurma imkanının sağlanmasını isteme hakkına sahiptir.

(Ek fıkra: 3/10/2001-4709/16 md.) Devlet, işlemlerinde, ilgili kişilerin hangi kanun yolları ve mercilere başvuracağını ve sürelerini belirtmek zorundadır.

Kişinin, Resmî görevliler tarafından vaki haksız işlemler sonucu uğradığı zarar da, kanuna göre, Devletçe tazmin edilir. Devletin sorumlu olan ilgili görevliye rücu hakkı saklıdır.
