Article 31: D. Right to use mass media other than the press owned by public legal persons

PART TWO: FUNDAMENTAL RIGHTS AND DUTIES › CHAPTER TWO: Rights and Duties of the Individual

Individuals and political parties have the right to use mass media and means of communication and broadcasting, other than the press, owned by public legal persons. The conditions and procedures for such use shall be regulated by law.

Amended paragraph: 3/10/2001, Law No. 4709, Art. 11 The law shall not impose restrictions preventing the public from receiving information or reaching ideas and opinions through these media, or preventing public opinion from being freely formed, on grounds other than national security, public order, or the protection of public morals and health.

MADDE 31 · D. Kamu tüzel kişilerinin elindeki basın dışı kitle haberleşme araçlarından yararlanma hakkı

Kişiler ve siyasi partiler, kamu tüzel kişilerinin elindeki basın dışı kitle haberleşme ve yayım araçlarından yararlanma hakkına sahiptir. Bu yararlanmanın şartları ve usulleri kanunla düzenlenir.

(Değişik fıkra: 3/10/2001-4709/11 md.) Kanun, millî güvenlik, kamu düzeni, genel ahlâk ve sağlığın korunması sebepleri dışında, halkın bu araçlarla haber almasını, düşünce ve kanaatlere ulaşmasını ve kamuoyunun serbestçe oluşmasını engelleyici kayıtlar koyamaz.
