(1) For projects exceeding the size to be determined by the Ministry according to the criterion of the number of residences in the project or the total price of the project, it is mandatory that, before commencing pre-paid residence sales, the seller take out building completion insurance, the scope, conditions and implementation principles of which are determined by the Undersecretariat of Treasury, or provide the other guarantees and conditions determined by the Ministry.
(2) The compensation, guarantees and similar securities provided under building completion insurance may not be included in the bankruptcy or liquidation estate, may not be attached, and may not be subjected to an interim injunction or a precautionary attachment.

MADDE 42 · Teminat
(1) Bakanlıkça projedeki konut adedi ya da projenin toplam bedeli kriterine göre belirlenecek büyüklüğün üzerindeki projeler için satıcının ön ödemeli konut satışına başlamadan önce; kapsamı, koşulları ve uygulama esasları Hazine Müsteşarlığınca belirlenen bina tamamlama sigortası yaptırması veya Bakanlıkça belirlenen diğer teminat ve şartları sağlaması zorunludur.
(2) Bina tamamlama sigortası kapsamında sağlanan tazminat, teminat ve benzeri güvenceler iflas veya tasfiye masasına dâhil edilemez, haczolunamaz, üzerlerine ihtiyati tedbir ve ihtiyati haciz konulamaz.
