Article 40: Prepaid housing sales contracts

Part Four: Consumer Contracts › Chapter Four: Prepaid Housing Sales

(1) A prepaid housing sales contract is a contract in which the consumer undertakes to pay the sale price of an immovable intended for housing in advance, in cash or in instalments, and the seller undertakes to transfer or deliver the immovable to the consumer after the price has been paid in full or in part.

(2) Consumers must be given, at least one day before the conclusion of the contract, a preliminary information form containing the matters determined by the Ministry.

(3) No prepaid housing sales contract may be concluded with consumers before a building permit has been obtained.

MADDE 40 · Ön ödemeli konut satış sözleşmeleri

(1) Ön ödemeli konut satış sözleşmesi, tüketicinin konut amaçlı bir taşınmazın satış bedelini önceden peşin veya taksitle ödemeyi, satıcının da bedelin tamamen veya kısmen ödenmesinden sonra taşınmazı tüketiciye devir veya teslim etmeyi üstlendiği sözleşmedir.

(2) Tüketicilere sözleşmenin kurulmasından en az bir gün önce, Bakanlıkça belirlenen hususları içeren ön bilgilendirme formu verilmek zorundadır.

(3) Yapı ruhsatı alınmadan, tüketicilerle ön ödemeli konut satış sözleşmesi yapılamaz.
