(1) Where an account is opened in connection with a housing finance contract and only credit-related transactions are carried out through this account, no fee or charge under any name may be demanded from the consumer in respect of this account. Unless the consumer requests otherwise in writing or by means of a durable medium, this account shall be closed upon repayment of the credit.
(2) No overdraft account contract linked to a housing finance contract may be concluded without the consumer's explicit instruction.
(3) In the application of the provisions of this Chapter, natural person members of housing construction cooperatives shall also be regarded as consumers.
(4) The procedures and principles concerning pre-contractual information, the rights and obligations of the consumer and the housing finance institution, the mandatory content of the contract, housing finance advertisements, refinancing, linked credit, default, early repayment, the calculation of the annual cost rate and other matters shall be determined by regulation.

MADDE 39 · Diğer hususlar
(1) Konut finansmanı sözleşmesine ilişkin bir hesap açılması ve bu hesaptan sadece kredi ile ilgili işlemler yapılması durumunda, tüketiciden bu hesaba ilişkin herhangi bir isim altında ücret veya masraf talep edilemez. Bu hesap, tüketicinin aksine yazılı veya kalıcı veri saklayıcısıyla talebi olmaması hâlinde kredinin ödenmesi ile kapanır.
(2) Tüketicinin açık talimatı olmaksızın konut finansmanı sözleşmesi ile ilişkili bir kredili mevduat sözleşmesi yapılamaz.
(3) Bu Bölüm hükümlerinin uygulanmasında, konut yapı kooperatiflerinin gerçek kişi ortakları da tüketici olarak kabul edilir.
(4) Sözleşme öncesi bilgilendirme, tüketici ile konut finansmanı kuruluşunun hak ve yükümlülükleri, sözleşmenin zorunlu içeriği, konut finansmanı reklamları, yeniden finansman, bağlı kredi, temerrüt, erken ödeme ve yıllık maliyet oranının hesaplanması ile diğer hususlara ilişkin usul ve esaslar yönetmelikle belirlenir.
