(1) Amended: 24/3/2022, Law No. 7392, Art. 12 The Ministry shall be responsible for establishing consumer arbitration committees in order to resolve disputes that may arise from consumer transactions and from practices directed at consumers. The territorial jurisdiction and division of work of consumer arbitration committees shall be determined by the Ministry.
(2) A consumer arbitration committee, chaired in provinces by the provincial director of trade and in districts by the district governor, or by a civil servant to be assigned by them, shall consist of:
a) one member to be assigned by the mayor from among municipal personnel who are experts in the matter,
b) one member to be assigned by the bar association from among its members,
c) in disputes where the seller is a merchant, one member to be assigned by the chamber of commerce and industry or, in places where these are organised separately, by the chamber of commerce; in disputes where the seller is a tradesman or craftsman, one member to be assigned in provinces by the union of chambers of tradesmen and craftsmen and in districts by the chamber of tradesmen and craftsmen having the largest number of members,
ç) one member to be elected by consumer organisations from among themselves,
making a total of five members including the chairperson. Substitutes for the chairperson and members having the qualifications set out in this paragraph shall also be designated separately. Added sentences: 11/7/2020, Law No. 7249, Art. 26 In provinces where more than one bar association has been established, the assignment of members to provincial and district consumer arbitration committees shall be made on the basis of equal and rotational representation of the bar associations. The procedures and principles concerning the assignment shall be set out in the regulation prepared by the Union of Turkish Bar Associations.
(3) In places where the formation of a consumer arbitration committee cannot be ensured, the vacant memberships shall be filled from among civil servants having the membership qualifications determined by regulation, in provinces by the provincial director of trade and in districts by the district governor.

MADDE 66 · Kuruluşu ve görev alanı
(1) (Değişik:24/3/2022-7392/12 md.) Bakanlık, tüketici işlemleri ile tüketiciye yönelik uygulamalardan doğabilecek uyuşmazlıklara çözüm bulmak amacıyla tüketici hakem heyetleri oluşturmakla görevlidir. Tüketici hakem heyetlerinin yetki alanı ile iş bölümü Bakanlıkça belirlenir.
(2) Başkanlığı illerde ticaret il müdürü, ilçelerde ise kaymakam veya bunların görevlendireceği bir memur tarafından yürütülen tüketici hakem heyeti;
a) Belediye başkanının konunun uzmanı belediye personeli arasından görevlendireceği bir üye,
b) Baronun, mensupları arasından görevlendireceği bir üye,
c) Satıcının tacir olduğu uyuşmazlıklarda ticaret ve sanayi odasının ya da bunların ayrı ayrı örgütlendiği yerlerde ticaret odasının; satıcının esnaf ve sanatkâr olduğu uyuşmazlıklarda, illerde esnaf ve sanatkârlar odaları birliğinin, ilçelerde ise en fazla üyeye sahip esnaf ve sanatkârlar odasının görevlendireceği bir üye,
ç) Tüketici örgütlerinin kendi aralarından seçecekleri bir üye,
olmak üzere başkan dâhil beş üyeden oluşur. Başkan ve üyelerin bu fıkrada yer alan niteliklere sahip yedekleri de ayrıca belirlenir. (Ek cümleler:11/7/2020-7249/26 md.) Birden fazla baro kurulan illerde il ve ilçe tüketici hakem heyetlerine üye görevlendirilmesi, baroların eşit ve dönüşümlü temsili esas alınarak yapılır. Görevlendirmeye ilişkin usul ve esaslar Türkiye Barolar Birliği tarafından hazırlanan yönetmelikte gösterilir.
(3) Tüketici hakem heyetinin oluşumunun sağlanamadığı yerlerde noksan üyelikler, yönetmelikle belirlenen üyelik niteliklerine sahip Devlet memurları arasından illerde ticaret il müdürü, ilçelerde ise kaymakam tarafından tamamlanır.
