Article 337: III. Where the mother and father are not married

Book Two: FAMILY LAW › Part Two: KINSHIP › Chapter One: ESTABLISHMENT OF DESCENT › Division Six: PARENTAL CUSTODY A. In general

If the mother and father are not married to each other, parental custody belongs to the mother.

If the mother is a minor, under interdiction or deceased, or parental custody has been withdrawn from her, the judge shall, according to the interest of the child, appoint a guardian or grant parental custody to the father.

MADDE 337 · III. Ana ve baba evli değilse

Ana ve baba evli değilse velâyet anaya aittir.

Ana küçük, kısıtlı veya ölmüş ya da velâyet kendisinden alınmışsa hâkim, çocuğun menfaatine göre, vasi atar veya velâyeti babaya verir.
