Article 551: II. Several executors

Book Three: LAW OF SUCCESSION › Part One: HEIRS › Chapter Two: DISPOSITIONS UPON DEATH › Division Five: EXECUTORS A. Appointment

Where more than one executor has been appointed, they shall perform the office jointly unless otherwise understood from the disposition or from the nature of the matter.

If one of them does not or cannot accept the office, or if his office ends for any reason, the others shall continue in office unless otherwise understood from the disposition of the testator.

Even if several executors have been appointed to act jointly, each of them may carry out the necessary acts in urgent cases.

MADDE 551 · II. Birden çok vasiyeti yerine getirme görevlisi

Birden çok vasiyeti yerine getirme görevlisinin atanmış olması hâlinde, tasarruftan veya işin niteliğinden aksi anlaşılmadıkça bunlar görevi birlikte yürütürler.

Bunlardan biri görevi kabul etmez veya edemez ya da herhangi bir sebeple görevi sona ererse, mirasbırakanın tasarrufundan aksi anlaşılmadıkça diğerleri göreve devam eder.

Birden çok vasiyeti yerine getirme görevlisi birlikte hareket etmek üzere atanmış olsa bile acele hâllerde her biri gerekli işlemleri yapabilir.
