Unless the testator has provided otherwise in his disposition or has conferred a limited mandate, the executor shall be charged with and authorised to carry out all acts necessary for the execution of the last wishes of the testator.
The executor shall in particular:
1. Without delay after taking up office, draw up a list of the property, rights and debts of the estate. Where possible, the heirs shall be present when the list is drawn up.
2. Administer the estate and request the transfer to himself of possession of the estate property to the extent required by the administration.
3. Collect the claims of the estate and pay its debts.
4. Execute the legacies.
5. Prepare a plan for the partition of the estate.
6. Represent the community of heirs in actions and enforcement proceedings relating to the estate. He may intervene in actions brought by the heirs that relate to his office.
7. Notify the heirs of the actions brought by or against him and of the enforcement proceedings conducted.

MADDE 552 · I. Genel olarak
Mirasbırakan, tasarrufunda aksini öngörmüş veya sınırlı bir görev vermiş olmadıkça vasiyeti yerine getirme görevlisi, mirasbırakanın son arzularının yerine getirilmesi için gerekli bütün işlemleri yapmakla görevli ve yetkilidir.
Vasiyeti yerine getirme görevlisi, özellikle;
1. Göreve başladıktan sonra gecikmeksizin terekedeki malların, hakların ve borçların listesini düzenler. Liste düzenlenirken olanak varsa mirasçılar hazır bulundurulur.
2. Terekeyi yönetir ve yönetimin gerektirdiği ölçüde tereke mallarının zilyetliğinin kendisine devrini ister.
3. Tereke alacaklarını tahsil eder, borçlarını öder.
4. Vasiyetleri yerine getirir.
5. Terekenin paylaşılması için plân hazırlar.
6. Tereke ile ilgili dava ve takiplerde miras ortaklığını temsil eder. Mirasçılar tarafından açılmış davalardan görevi ile ilgili olanlara müdahil olarak katılabilir.
7. Açtığı veya aleyhine açılan davalar ile yapılan takipleri mirasçılara bildirir.
