Article 647: I. Disposition of the deceased

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Three: PARTITION OF THE ESTATE › Division Two: MODE OF PARTITION

The deceased may, by a disposition upon death, lay down rules on how the partition is to be carried out and how the shares are to be formed.

These rules shall be binding on the heirs, without prejudice to the possibility of equalising the shares in the case of an inequality not intended by the deceased.

Unless it is apparent from the disposition that the deceased intended otherwise, the allotment by the deceased of an estate asset to an heir shall not be deemed a legacy but merely a rule of partition.

MADDE 647 · I. Mirasbırakanın tasarrufu

Mirasbırakan, ölüme bağlı tasarrufuyla paylaşmanın nasıl yapılacağı ve payların nasıl oluşturulacağı hakkında kurallar koyabilir.

Bu kurallar, mirasbırakan tarafından kastedilmemiş olan bir eşitsizlik hâlinde payların denkleştirilmesi olanağı saklı kalmak kaydıyla, mirasçılar için bağlayıcıdır.

Aksini arzu ettiği tasarruftan anlaşılmadıkça, mirasbırakanın tereke malını bir mirasçıya özgülemesi, vasiyet olmayıp sadece paylaştırma kuralı sayılır.
