Article 651: III. Allotment or sale of certain assets

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Three: PARTITION OF THE ESTATE › Division Two: MODE OF PARTITION

An estate asset that cannot be divided without a considerable reduction in its value shall be allotted in its entirety to one of the heirs.

Where the heirs cannot agree on the division or allotment of an estate asset, that asset shall be sold and the proceeds shall be divided.

Where one of the heirs so requests, the sale shall be made by auction. Where the heirs cannot agree on the form of the auction, the judge of the civil court of peace shall decide whether the auction is to be held among the heirs or to be open to the public.

MADDE 651 · III. Bazı malların özgülenmesi veya satılması

Değerinde önemli azalma olmadan bölünemeyen tereke malı, bütün olarak mirasçılardan birine özgülenir.

Mirasçılar bir tereke malının bölünmesi veya özgülenmesi konusunda anlaşamazlarsa, o mal satılır ve bedeli bölüştürülür.

Mirasçılardan biri istemde bulunursa satış artırma yoluyla yapılır. Mirasçılar artırmanın şekli konusunda anlaşamazlarsa sulh hâkimi, artırmanın mirasçılar arasında veya herkese açık yapılmasına karar verir.
