Article 646: A. In general

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Three: PARTITION OF THE ESTATE › Division Two: MODE OF PARTITION

Statutory heirs, whether among themselves or together with appointed heirs, shall partition the estate in accordance with the same rules.

Unless otherwise provided, the heirs shall freely agree on how the partition is to be carried out.

Heirs who are in possession of estate assets or who are indebted to the deceased shall be obliged to provide complete information thereon at the time of partition.

MADDE 646 · A. Genel olarak

Yasal mirasçılar, gerek kendi aralarında, gerek atanmış mirasçılarla birlikte mirası aynı kurallara göre paylaşırlar.

Aksine düzenleme olmadıkça mirasçılar, paylaşmanın nasıl yapılacağını serbestçe kararlaştırırlar.

Tereke mallarına zilyet olan veya mirasbırakana borçlu bulunan mirasçılar, paylaşma sırasında bu konuda eksiksiz bilgi vermekle yükümlüdürler.
