Article 804: b. Natural fruits

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter One: SERVITUDES AND LAND CHARGES › Division Two: USUFRUCT AND OTHER SERVITUDES A. Usufruct

Natural fruits that ripen during the term of the usufruct belong to the usufructuary.

The owner or usufructuary who did the sowing or planting may claim from the other party who gathers the ripened fruits appropriate compensation for the expenses incurred, not exceeding the value of the fruits.

Component parts which by their nature are not considered natural yields or fruits of the asset belong to the owner.

MADDE 804 · b. Doğal ürünler

İntifa hakkı süresi içinde olgunlaşan doğal ürünler, intifa hakkı sahibine aittir.

Ekimi veya dikimi yapan malik veya intifa hakkı sahibi, olgunlaşan ürünleri toplayan diğer taraftan, yaptığı giderler için ürünün değerini aşmamak üzere uygun bir bedel isteyebilir.

Nitelikleri itibarıyla malın doğal verimi veya ürünü sayılmayan bütünleyici parçaları malike aittir.
