Article 886: b. Public auction

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter Two: CHARGES ON IMMOVABLE PROPERTY › Division Two: MORTGAGE

In response to the notice of redemption, the creditors may, within one month from service of the notice and upon advance payment of the costs, request that the mortgaged immovable be sold by public auction.

The sale shall be carried out by the enforcement office in accordance with the provisions of the Enforcement and Bankruptcy Law.

Where the amount obtained at the public auction exceeds the purchase price or the price assessed by the owner, that amount shall be deemed the redemption price. Where the auction price is higher, the costs of the public auction shall be borne by the owner; otherwise, by the creditor who requested the public auction.

MADDE 886 · b. Açık artırma

İpotekten kurtarma ihbarına karşı alacaklılar, ihbarın tebliğinden başlayarak bir ay içinde giderleri peşin ödemek suretiyle, ipotekli taşınmazın açık artırma yoluyla satılmasını isteyebilirler.

Satış, icra dairesince İcra ve İflâs Kanunu hükümlerine göre yapılır.

Açık artırmada elde edilen miktarın satış bedelinden veya malik tarafından takdir edilen bedelden fazla olması hâlinde, bu miktar ipotekten kurtarma bedeli sayılır. Artırma bedelinin fazla olduğu hâllerde açık artırma giderleri malike, aksi hâlde açık artırmayı isteyen alacaklıya ait olur.
