Article 889: 2. Division of the immovable

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter Two: CHARGES ON IMMOVABLE PROPERTY › Division Two: MORTGAGE

Where part of the mortgaged immovable, or one of several mortgaged immovables belonging to the same owner, is transferred to another person, or the mortgaged immovable is divided, the charge shall, unless otherwise agreed, be distributed by the land registry office of its own motion among the immovables in proportion to their values.

A creditor who does not accept this distribution may, by giving written notice within one month from service on him or her of the notification that the distribution has become final, require the debtor to pay the claim within one year.

Where the new owners assume the debt falling on the immovables belonging to them, the debtor is released from the debt unless the creditor notifies the former debtor in writing within one year that the creditor reserves the right of recourse against him or her.

MADDE 889 · 2. Taşınmazın bölünmesi

İpotekli taşınmazın bir kısmının veya aynı malike ait bulunan ipotekli taşınmazlardan birinin başkasına devredilmesi ya da ipotekli taşınmazın bölünmesi hâlinde, aksine bir anlaşma yoksa, rehin taşınmazlara değerleri oranında tapu idaresince re'sen dağıtılır.

Bu dağıtımı kabul etmeyen alacaklı, dağıtımın kesinleştiğinin kendisine tebliğinden başlayarak bir ay içinde yazılı bildirimde bulunmak suretiyle alacağın bir yıl içinde ödenmesini borçludan isteyebilir.

Yeni malikler, kendilerine ait taşınmaza düşen borcu yüklendikleri takdirde alacaklı, kendisine başvurma hakkını saklı tuttuğunu önceki borçluya bir yıl içinde yazılı olarak bildirmezse, borçlu borcundan kurtulur.
