Article 246: Letter of safe conduct to be issued to the accused

Book Five: Special Trial Procedures › Part One: Trial of Absent and Fugitive Persons, Representation of Legal Persons in Investigation and Prosecution, Procedure Relating to Certain Offences › Chapter One: Trial of Absent Persons

(1) The court may issue a letter of safe conduct to an absent accused, guaranteeing that he will not be detained if he appears at the hearing, and this guarantee may be made subject to conditions.

(2) If the accused is sentenced to imprisonment, or prepares to flee, or fails to comply with the conditions to which the letter of safe conduct is subject, the letter shall lose its effect.

MADDE 246 · Sanığa verilecek güvence belgesi

(1) Mahkeme, gaip olan sanık hakkında duruşmaya gelmesi hâlinde tutuklanmayacağı hususunda bir güvence belgesi verebilir ve bu güvence koşullara bağlanabilir.

(2) Sanık, hapis cezası ile mahkûm olur veya kaçmak hazırlığında bulunur veya güvence belgesinin bağlı olduğu koşullara uymazsa belgenin hükmü kalmaz.
