Article 377: II. Liability

Part Two: Special Obligational Relationships › Chapter Four: Lease Contract › Division Three: Usufructuary Lease

Unless there is an agreement or local custom to the contrary, the lessee shall be liable for any damage suffered by the leased animals, unless he or she proves that this damage occurred despite the exercise of attention and care in their safekeeping.

The lessee may claim compensation from the lessor for extraordinary safekeeping expenses not caused by his or her own fault.

The lessee shall be obliged to notify the lessor of serious accidents or illnesses without delay.

MADDE 377 · II. Sorumluluk

Aksine anlaşma veya yerel âdet yoksa kiracı, kiralanan hayvanların uğradığı bir zarardan, bu zararın, korumada dikkat ve özen gösterildiği hâlde meydana gelmiş olduğunu ispat etmedikçe sorumludur.

Kiracı, kendi kusuruyla sebebiyet vermediği olağanüstü koruma giderleri için kiraya verenden tazminat isteyebilir.

Kiracı, önemli kazaları ya da hastalıkları gecikmeksizin kiraya verene bildirmekle yükümlüdür.
