Article 556: I. Relationship between the assignor and the assignee

Part Two: Special Obligational Relationships › Chapter Thirteen: Assignment (Havale)

Where the assignment is made for the purpose of discharging a debt owed by the assignor to the assignee, that debt shall be extinguished only upon performance by the assigned debtor.

An assignee who has accepted the assignment may again assert his or her claim against the assignor if, having applied to the assigned debtor, he or she has been unable to obtain payment within the time specified in the assignment.

If an assignee who is a creditor does not wish to accept the assignment, he or she must notify the assignor, who is the debtor, without delay; failing such notification, he or she shall be obliged to compensate the resulting damage.

MADDE 556 · I. Havale eden ile havale alıcısı arasındaki ilişki

Havale, havale edenin havale alıcısına olan borcunun ifası amacıyla yapılıyorsa, bu borç ancak havale ödeyicisinin borcu ifa etmesiyle sona erer.

Havaleyi kabul etmiş olan havale alıcısı, havale ödeyicisine başvurarak havalede belirlenen süre içinde alacağını elde edememişse, bu alacağı, havale edene karşı yeniden ileri sürebilir.

Alacaklı olan havale alıcısı, havaleyi kabul etmek istemezse, durumu borçlu olan havale edene gecikmeksizin bildirmek zorundadır; bildirmezse bundan doğan zararı gidermekle yükümlü olur.
