(1) A public official who, knowing that it is contrary to the conditions laid down in the relevant laws, forcibly disposes of the movable or immovable property of persons, even against payment of compensation, shall, provided that the act does not constitute an offence requiring a heavier penalty, be punished with imprisonment from six months to two years.

MADDE 261 · Kişilerin malları üzerinde usulsüz tasarruf
(1) İlgili kanunlarda belirlenen koşullara aykırı olduğunu bilerek, kişilerin taşınır veya taşınmaz malları üzerinde, karşılık ödenmek suretiyle de olsa, zorla tasarrufta bulunan kamu görevlisi, fiil daha ağır cezayı gerektiren bir suç oluşturmadığı takdirde, altı aydan iki yıla kadar hapis cezası ile cezalandırılır.
