Article 58: Persons left out of registration

Part Nine: Common Provisions

(1) Persons left unrecorded in population registrations shall apply, with official documents showing that they are Turkish citizens, to the civil registry directorate of the place where they are located in Türkiye or, if abroad, to the nearest foreign mission. If, as a result of the examination to be carried out, there is no circumstance preventing their registration, they shall be registered in the family registers by the civil registry directorates.

(2) Added: 19/10/2017, Law No. 7039, Art. 18 Persons who died before the population registrations shall not be registered in the family registers. However, upon submission of the identity document of a person who died before the local registration and of a document relating to the death, an annotation shall be made in the records of the person's statutory heirs.

MADDE 58 · Yazım dışı kalanlar

(1) Nüfus yazımlarında kayıt dışı kalanlar Türkiye'de bulundukları yerin nüfus müdürlüğüne, yurt dışında ise en yakın dış temsilciliğe Türk vatandaşı olduklarını gösterir resmî belgeler ile müracaat ederler. Yapılacak inceleme sonucunda tescillerine engel bir halin bulunmaması halinde, nüfus müdürlüklerince aile kütüklerine tescil edilirler.

(2) (Ek: 19/10/2017-7039/18 md.) Nüfus yazımlarından önce ölenler aile kütüklerine tescil edilmez. Ancak, yersel yazımdan önce ölen kişiye ait kimlik ile ölüme ilişkin belge ibrazı hâlinde kişinin kanunî mirasçılarının kaydına açıklama yapılır.
