Article 179: Effect of amendment

Part Three: Written Procedure › Chapter Five: Taking of Evidence and Special Circumstances During the Taking of Evidence › Division Six: Amendment of Procedural Acts and Correction of Clerical Errors

(1) Amendment shall result in all procedural acts being deemed not to have been performed, from the point to which the party making it extends it.

(2) However, an admission, witness statements, expert reports and statements, records of on-site inspection and of interrogation, and the tender, refusal or referral back of an oath, whether already administered or not yet administered provided that the opposing party has declared before the amendment that it would take the oath, cannot be rendered invalid by amendment.

(3) Nevertheless, if, according to the result of the investigation to be conducted after the amendment, it is not necessary to take these acts into consideration, they shall also be deemed not to have been performed.

MADDE 179 · Islahın etkisi

(1) Islah, bunu yapan tarafın teşmil edeceği noktadan itibaren, bütün usul işlemlerinin yapılmamış sayılması sonucunu doğurur.

(2) Ancak ikrar, tanık ifadeleri, bilirkişi rapor ve beyanları, keşif ve isticvap tutanakları, yerine getirilmiş olan veya henüz yerine getirilmemiş olmakla beraber, karşı tarafın yerine getireceğini ıslahtan önce bildirmiş olması koşuluyla, yeminin teklifi, reddi veya iadesi ıslah ile geçersiz kılınamaz.

(3) Şu kadar ki, ıslahtan sonra yapılacak tahkikat sonucuna göre, bu işlemlerin göz önünde tutulması gerekmiyorsa, bunlar da yapılmamış sayılır.
