Article 177: Time and form of amendment

Part Three: Written Procedure › Chapter Five: Taking of Evidence and Special Circumstances During the Taking of Evidence › Division Six: Amendment of Procedural Acts and Correction of Clerical Errors

(1) Amendment may be made until the end of the taking of evidence.

(2) Added: 22/7/2020, Law No. 7251, Art. 18 When the case file is sent to the court of first instance after a reversal decision of the Court of Cassation or a setting-aside decision of the regional court of appeal, if the court of first instance performs an act relating to the taking of evidence, amendment may also be made until the taking of evidence ends. However, the legal situation arising from compliance with the reversal decision may not be eliminated.

(3) Amendment may be made orally or in writing. If the opposing party is not present at the hearing or if the request for amendment is made outside the hearing, this written request or a copy of the minutes shall be notified to the opposing party for information purposes.

MADDE 177 · Islahın zamanı ve şekli

(1) Islah, tahkikatın sona ermesine kadar yapılabilir.

(2) (Ek:22/7/2020-7251/18 md.) Yargıtayın bozma kararından veya bölge adliye mahkemesinin kaldırma kararından sonra dosya ilk derece mahkemesine gönderildiğinde, ilk derece mahkemesinin tahkikata ilişkin bir işlem yapması hâlinde tahkikat sona erinceye kadar da ıslah yapılabilir. Ancak bozma kararına uymakla ortaya çıkan hukuki durum ortadan kaldırılamaz.

(3) Islah, sözlü veya yazılı olarak yapılabilir. Karşı taraf duruşmada hazır değilse veya ıslah talebi duruşma dışında yapılıyorsa, bu yazılı talep veya tutanak örneği, haber vermek amacıyla karşı tarafa bildirilir.
