Article 171: Summoning of the party to be interrogated

Part Three: Written Procedure › Chapter Five: Taking of Evidence and Special Circumstances During the Taking of Evidence › Division Five: Interrogation of the Parties

(1) A summons shall be sent personally to the person whose interrogation has been ordered, stating that the person must be present on the set day and time to be interrogated. The summons shall also indicate the facts that are the subject of the interrogation, and shall contain a warning that, if the party concerned fails to appear without a valid excuse, or appears but does not answer the questions, that party shall be deemed to have admitted the facts that are the subject of the interrogation.

(2) If the summoned party fails to appear without an excuse, or appears but leaves the questions unanswered, the facts asked by the court shall be deemed admitted.

MADDE 171 · İsticvap olunacak tarafın davet edilmesi

(1) İsticvabına karar verilen kimseye bizzat davetiye gönderilir ve belirlenen gün ve saatte isticvap olunmak üzere hazır bulunması gerektiği belirtilir. Davetiyede, ayrıca, isticvap konusu vakıalar gösterilir; ilgili tarafın geçerli bir özrü olmaksızın gelmediği veya gelip de sorulara cevap vermediği takdirde, isticvap konusu vakıaları ikrar etmiş sayılacağı ihtarı da yapılır.

(2) Çağrılan taraf özürsüz olarak gelmediği veya gelip de soruları cevapsız bıraktığı takdirde, mahkemece sorulan vakıalar ikrar edilmiş sayılır.
