Article 157: Mandatory presence of a court clerk

Part Three: Written Procedure › Chapter Five: Taking of Evidence and Special Circumstances During the Taking of Evidence › Division Two: Hearing

(1) The presence of a court clerk is mandatory in all acts to be performed in the presence of the judge, whether in court or outside the court.

(2) Where the court clerk is unable to perform his or her duty owing to legal or factual impediments and delay would be detrimental, another person may be assigned as court clerk, provided that such person is made to take an oath appropriate to the nature of the duty.

MADDE 157 · Zabıt kâtibi bulundurulması zorunluluğu

(1) Mahkemede veya mahkeme dışında hâkim huzuruyla yapılacak bütün işlemlerde zabıt kâtibinin hazır bulunması zorunludur.

(2) Hukuki veya fiilî engellerle zabıt kâtibi görev yapamayacak durumda olur ve işin gecikmesinde sakınca bulunursa, görevin niteliğine uygun yemin ettirilmek koşuluyla, başka bir kimse, zabıt kâtibi olarak görevlendirilebilir.
