Article 161: Examination of the case file by the parties and persons concerned

Part Three: Written Procedure › Chapter Five: Taking of Evidence and Special Circumstances During the Taking of Evidence › Division Two: Hearing

(1) The parties or the secondary intervener may examine the case file under the supervision of the court clerk. Persons having an interest in the action may also examine the case file, provided that they prove such interest and with the permission of the judge.

(2) The examination of documents and minutes that have been ordered to be kept confidential shall be subject to the express permission of the judge.

MADDE 161 · Dosyanın taraflar ve ilgililerce incelenmesi

(1) Zabıt kâtibinin gözetimi altında taraflar veya fer’î müdahil, dava dosyasını inceleyebilir. Dava ile ilgili olanlar da bunu ispatlamak kaydı ve hâkimin izniyle dosyayı inceleyebilir.

(2) Gizli olarak saklanmasına karar verilen belge ve tutanakların incelenebilmesi hâkimin açık iznine bağlıdır.
