Article 22: Reviewing authority

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Three: Steps to Be Taken upon a Decision of Lack of Subject-Matter or Territorial Jurisdiction and Determination of the Forum

(1) Where there is any impediment to the hearing of an action by the court having jurisdiction, or where doubt arises as to the determination of the boundaries of the judicial districts between two courts, application for the designation of the competent court shall be made to the regional courts of appeal in respect of first instance courts, and to the Court of Cassation in respect of regional courts of appeal.

(2) Where the decisions rendered by two courts on subject-matter or territorial jurisdiction concerning the same action become final without recourse to legal remedies, the court having subject-matter or territorial jurisdiction shall be determined, as the case may be, by the regional court of appeal or by the Court of Cassation.

MADDE 22 · İnceleme yeri

(1) Yetkili mahkemenin bir davaya bakmasına herhangi bir engel bulunduğu yahut iki mahkeme arasında yargı çevrelerinin sınırlarının belirlenmesinde tereddüt ortaya çıktığı takdirde, yetkili mahkemenin tayininde, ilk derece mahkemeleri için bölge adliye mahkemelerine, bölge adliye mahkemeleri için Yargıtaya başvurulur.

(2) İki mahkemenin aynı dava hakkında göreve veya yetkiye ilişkin olarak verdikleri kararlar kanun yoluna başvurulmaksızın kesinleştiği takdirde, görevli veya yetkili mahkeme, ilgisine göre bölge adliye mahkemesince veya Yargıtayca belirlenir.
