Article 18: Conditions of validity of the jurisdiction agreement

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Two: Territorial Jurisdiction

(1) A jurisdiction agreement may not be concluded in respect of matters over which the parties cannot freely dispose, nor in cases of exclusive jurisdiction.

(2) For a jurisdiction agreement to be valid, it must be made in writing, the legal relationship from which the dispute arises must be specific or determinable, and the court or courts on which jurisdiction is conferred must be indicated.

MADDE 18 · Yetki sözleşmesinin geçerlilik şartları

(1) Tarafların üzerinde serbestçe tasarruf edemeyecekleri konular ile kesin yetki hâllerinde, yetki sözleşmesi yapılamaz.

(2) Yetki sözleşmesinin geçerli olabilmesi için yazılı olarak yapılması, uyuşmazlığın kaynaklandığı hukuki ilişkinin belirli veya belirlenebilir olması ve yetkili kılınan mahkeme veya mahkemelerin gösterilmesi şarttır.
