Article 7: Jurisdiction where there is more than one defendant

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Two: Territorial Jurisdiction

(1) If there is more than one defendant, the action may be brought in the court of the domicile of any one of them. However, if the law designates, according to the cause of action, a court having common jurisdiction over all of the defendants, the action shall be heard by the court of that place.

(2) Where there are several defendants, if it is understood from evidence or indications that the action has been brought solely for the purpose of bringing one of the defendants before a court other than the court of his or her own domicile, the court shall, upon the objection of the defendant concerned, sever the action against that defendant and render a decision of lack of territorial jurisdiction.

MADDE 7 · Davalının birden fazla olması hâlinde yetki

(1) Davalı birden fazla ise dava, bunlardan birinin yerleşim yeri mahkemesinde açılabilir. Ancak, dava sebebine göre kanunda, davalıların tamamı hakkında ortak yetkiyi taşıyan bir mahkeme belirtilmişse, davaya o yer mahkemesinde bakılır.

(2) Birden fazla davalının bulunduğu hâllerde, davanın, davalılardan birini sırf kendi yerleşim yeri mahkemesinden başka bir mahkemeye getirmek amacıyla açıldığı, deliller veya belirtilerle anlaşılırsa, mahkeme, ilgili davalının itirazı üzerine, onun hakkındaki davayı ayırarak yetkisizlik kararı verir.
