Article 9: Jurisdiction in the absence of a domicile in Türkiye

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Two: Territorial Jurisdiction

(1) The court of general jurisdiction over persons who do not have a domicile in Türkiye is the court of the place where the defendant's habitual residence in Türkiye is located. However, without prejudice to other cases of special jurisdiction, an action concerning property rights may also be brought in the place where the asset in dispute is located.

MADDE 9 · Türkiye’de yerleşim yerinin bulunmaması hâlinde yetki

(1) Türkiye’de yerleşim yeri bulunmayanlar hakkında genel yetkili mahkeme, davalının Türkiye’deki mutad meskeninin bulunduğu yer mahkemesidir. Ancak, diğer özel yetki hâlleri saklı kalmak üzere, malvarlığı haklarına ilişkin dava, uyuşmazlık konusu malvarlığı unsurunun bulunduğu yerde de açılabilir.
