Article 21: Grounds requiring determination of the forum

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Three: Steps to Be Taken upon a Decision of Lack of Subject-Matter or Territorial Jurisdiction and Determination of the Forum

(1) In the following cases, recourse shall be had to the determination of the forum in order to designate the court that will hear the action:

a) If any impediment arises to the hearing of the action by the court having subject-matter and territorial jurisdiction to hear it.

b) If any doubt arises between two courts as to the determination of the boundaries of their judicial districts.

c) If both courts render decisions of lack of subject-matter jurisdiction and these decisions become final without recourse to legal remedies.

ç) If, in cases of exclusive jurisdiction, both courts render decisions of lack of territorial jurisdiction and these decisions become final without recourse to legal remedies.

MADDE 21 · Yargı yeri belirlenmesini gerektiren sebepler

(1) Aşağıdaki hâllerde, davaya bakacak mahkemenin tayini için yargı yeri belirlenmesi yoluna başvurulur:

a) Davaya bakmakla görevli ve yetkili mahkemenin davaya bakmasına herhangi bir engel çıkarsa.

b) İki mahkeme arasında yargı çevrelerinin sınırlarının belirlenmesi konusunda bir tereddüt ortaya çıkarsa.

c) İki mahkeme de görevsizlik kararı verir ve bu kararlar kanun yoluna başvurulmaksızın kesinleşirse.

ç) Kesin yetki hâllerinde, iki mahkeme de yetkisizlik kararı verir ve bu kararlar kanun yoluna başvurulmaksızın kesinleşirse.
