Article 20: Steps to be taken upon a decision of lack of subject-matter or territorial jurisdiction

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Three: Steps to Be Taken upon a Decision of Lack of Subject-Matter or Territorial Jurisdiction and Determination of the Forum

(1) Where a decision of lack of subject-matter jurisdiction or lack of territorial jurisdiction is rendered, one of the parties must apply to the court that rendered the decision within two weeks, running from the date of service if the decision is final when rendered, from the date on which the decision became final if it became final because no legal remedy was sought (…) within the time limit, or from the date of service of the decision rejecting the application if a legal remedy was sought, and request that the case file be sent to the court having subject-matter or territorial jurisdiction. Otherwise, the action shall be deemed not to have been brought, and the court that rendered the decision of lack of subject-matter or territorial jurisdiction shall decide on this matter of its own motion.

(2) The court to which the file is sent shall, of its own motion, send summonses to the parties.

MADDE 20 · Görevsizlik veya yetkisizlik kararı üzerine yapılacak işlemler

(1) Görevsizlik veya yetkisizlik kararı verilmesi hâlinde, taraflardan birinin, bu karar verildiği anda kesin ise tebliğ tarihinden, (…) süresi içinde kanun yoluna başvurulmayarak kesinleşmiş ise kararın kesinleştiği tarihten; kanun yoluna başvurulmuşsa bu başvurunun reddi kararının tebliğ tarihinden itibaren iki hafta içinde kararı veren mahkemeye başvurarak, dava dosyasının görevli ya da yetkili mahkemeye gönderilmesini talep etmesi gerekir. Aksi takdirde dava açılmamış sayılır ve görevsizlik veya yetkisizlik kararı veren mahkemece bu konuda resen karar verilir.

(2) Dosya kendisine gönderilen mahkeme, kendiliğinden taraflara davetiye gönderir.
