Article 11: Jurisdiction in actions arising from inheritance

Chapter One: Subject-Matter Jurisdiction, Territorial Jurisdiction and Determination of the Forum › Division Two: Territorial Jurisdiction

(1) In the following actions, the court of the last domicile of the deceased shall have exclusive jurisdiction:

a) Actions concerning the partition of the estate, the invalidity of a partition agreement concluded, the annulment and reduction of dispositions mortis causa, and claims for recovery based on inheritance, as well as actions among heirs arising from the administration of the estate.

b) All actions to be brought against the heirs until the final partition of the estate.

(2) An action for recovery intended to be brought concerning an asset forming part of the estate may also be brought in the place where the asset was located at the time of the inventory and determination of the estate.

(3) In actions concerning the annulment of a certificate of inheritance and the issuance of a new certificate of inheritance, the court of the place where each of the heirs resides shall also have jurisdiction.

MADDE 11 · Mirastan doğan davalarda yetki

(1) Aşağıdaki davalarda, ölen kimsenin son yerleşim yeri mahkemesi kesin yetkilidir:

a) Terekenin paylaşılmasına, yapılan paylaşma sözleşmesinin geçersizliğine, ölüme bağlı tasarrufların iptali ve tenkisine, miras sebebiyle istihkaka ilişkin davalar ile mirasçılar arasında terekenin yönetiminden kaynaklanan davalar.

b) Terekenin kesin paylaşımına kadar mirasçılara karşı açılacak tüm davalar.

(2) Terekede bulunan bir mal hakkında açılmak istenen istihkak davası, terekenin yazımı ve tespiti zamanında mal nerede bulunuyorsa, orada da açılabilir.

(3) Mirasçılık belgesinin iptali ve yeni mirasçılık belgesi verilmesine ilişkin davalarda, mirasçıların her birinin oturduğu yer mahkemesi de yetkilidir.
