Article 25: Principle of party presentation

Chapter Two: Principles Governing the Proceedings

(1) Except for the exceptions provided by law, the judge may not, of his or her own motion, take into consideration anything or any facts not stated by either of the two parties, and may not even engage in conduct that may remind them of such matters.

(2) Except in the cases specified by law, the judge may not collect evidence of his or her own motion.

MADDE 25 · Taraflarca getirilme ilkesi

(1) Kanunda öngörülen istisnalar dışında, hâkim, iki taraftan birinin söylemediği şeyi veya vakıaları kendiliğinden dikkate alamaz ve onları hatırlatabilecek davranışlarda dahi bulunamaz.

(2) Kanunla belirtilen durumlar dışında, hâkim, kendiliğinden delil toplayamaz.
