Article 361: Decisions subject to appeal on points of law

Part Eight: Legal Remedies › Chapter Two: Appeal on Points of Law (Temyiz)

(1) An appeal on points of law (temyiz) may be filed, within two weeks from the date of service, against final decisions of the civil chambers of the regional courts of appeal that are subject to appeal on points of law, and against decisions rendered upon requests for the annulment of arbitral awards.

(2) The party who prevailed in the action may also file an appeal on points of law, provided that it has a legal interest.

MADDE 361 · Temyiz edilebilen kararlar

(1) Bölge adliye mahkemesi hukuk dairelerinden verilen temyizi kabil nihai kararlar ile hakem kararlarının iptali talebi üzerine verilen kararlara karşı tebliğ tarihinden itibaren iki hafta içinde temyiz yoluna başvurulabilir.

(2) Davada haklı çıkmış olan taraf da hukuki yararı bulunmak şartıyla temyiz yoluna başvurabilir.
