(1) Where it is established that the goods are defective, the consumer may exercise one of the following optional rights:
a) to withdraw from the contract by declaring readiness to return the goods sold,
b) to retain the goods sold and request a reduction of the sale price in proportion to the defect,
c) to request free repair of the goods sold, all expenses being borne by the seller, provided this does not require excessive expense,
ç) where possible, to request replacement of the goods sold with a defect-free equivalent,
(the foregoing being the consumer's optional rights). The seller shall be obliged to fulfil the request preferred by the consumer.
(2) The rights to free repair or to replacement of the goods with a defect-free equivalent may also be exercised against the producer or importer. The seller, producer and importer shall be jointly and severally liable for fulfilling the rights under this paragraph. The producer or importer shall not be held liable if it proves that the defect arose after the goods were placed on the market by it.
(3) Where free repair or replacement of the goods with a defect-free equivalent would entail disproportionate difficulties for the seller, the consumer may exercise one of the rights to withdraw from the contract or to a reduction of the price in proportion to the defect. In determining disproportionality, matters such as the value of the goods without the defect, the significance of the defect, and whether recourse to the other optional rights would cause problems for the consumer shall be taken into account.
(4) Where one of the rights to free repair or to replacement of the goods with a defect-free equivalent is chosen, the request must be fulfilled within a maximum of thirty working days, or sixty working days in the case of immovable property intended for residential or holiday purposes, from the time the request is addressed to the seller, producer or importer. However, the consumer's request for free repair concerning goods included in the list annexed to the regulation issued pursuant to Article 58 of this Law shall be fulfilled within the maximum repair period determined in the regulation. Otherwise, the consumer shall be free to exercise its other optional rights.
(5) Where the consumer chooses the right to withdraw from the contract or to a reduction of the price in proportion to the defect, the entire price paid or the amount of the reduction made in the price shall be refunded to the consumer immediately.
(6) All expenses arising from the exercise of the optional rights shall be borne by the party fulfilling the right chosen by the consumer. Together with one of these optional rights, the consumer may also claim compensation pursuant to the provisions of the Turkish Code of Obligations No. 6098 of 11/1/2011.

MADDE 11 · Tüketicinin seçimlik hakları
(1) Malın ayıplı olduğunun anlaşılması durumunda tüketici;
a) Satılanı geri vermeye hazır olduğunu bildirerek sözleşmeden dönme,
b) Satılanı alıkoyup ayıp oranında satış bedelinden indirim isteme,
c) Aşırı bir masraf gerektirmediği takdirde, bütün masrafları satıcıya ait olmak üzere satılanın ücretsiz onarılmasını isteme,
ç) İmkân varsa, satılanın ayıpsız bir misli ile değiştirilmesini isteme,
seçimlik haklarından birini kullanabilir. Satıcı, tüketicinin tercih ettiği bu talebi yerine getirmekle yükümlüdür.
(2) Ücretsiz onarım veya malın ayıpsız misli ile değiştirilmesi hakları üretici veya ithalatçıya karşı da kullanılabilir. Bu fıkradaki hakların yerine getirilmesi konusunda satıcı, üretici ve ithalatçı müteselsilen sorumludur. Üretici veya ithalatçı, malın kendisi tarafından piyasaya sürülmesinden sonra ayıbın doğduğunu ispat ettiği takdirde sorumlu tutulmaz.
(3) Ücretsiz onarım veya malın ayıpsız misli ile değiştirilmesinin satıcı için orantısız güçlükleri beraberinde getirecek olması hâlinde tüketici, sözleşmeden dönme veya ayıp oranında bedelden indirim haklarından birini kullanabilir. Orantısızlığın tayininde malın ayıpsız değeri, ayıbın önemi ve diğer seçimlik haklara başvurmanın tüketici açısından sorun teşkil edip etmeyeceği gibi hususlar dikkate alınır.
(4) Ücretsiz onarım veya malın ayıpsız misli ile değiştirilmesi haklarından birinin seçilmesi durumunda bu talebin satıcıya, üreticiye veya ithalatçıya yöneltilmesinden itibaren azami otuz iş günü, konut ve tatil amaçlı taşınmazlarda ise altmış iş günü içinde yerine getirilmesi zorunludur. Ancak, bu Kanunun 58 inci maddesi uyarınca çıkarılan yönetmelik eki listede yer alan mallara ilişkin, tüketicinin ücretsiz onarım talebi, yönetmelikte belirlenen azami tamir süresi içinde yerine getirilir. Aksi hâlde tüketici diğer seçimlik haklarını kullanmakta serbesttir.
(5) Tüketicinin sözleşmeden dönme veya ayıp oranında bedelden indirim hakkını seçtiği durumlarda, ödemiş olduğu bedelin tümü veya bedelden yapılan indirim tutarı derhâl tüketiciye iade edilir.
(6) Seçimlik hakların kullanılması nedeniyle ortaya çıkan tüm masraflar, tüketicinin seçtiği hakkı yerine getiren tarafça karşılanır. Tüketici bu seçimlik haklarından biri ile birlikte 11/1/2011 tarihli ve 6098 sayılı Türk Borçlar Kanunu hükümleri uyarınca tazminat da talep edebilir.
