Article 17: Instalment sales contracts

Part Four: Consumer Contracts › Chapter One: Instalment Sales

(1) Instalment sales contracts are contracts under which the seller or provider undertakes the delivery of goods or the performance of services and the consumer pays the price in instalments.

(2) The provisions of this Chapter shall also apply to financial leasing contracts under which the consumer is obliged to acquire ownership of goods at the end of the lease term.

(3) An instalment sales contract shall not be valid unless concluded in writing. A seller or provider who has not concluded a valid contract may not subsequently assert the invalidity of the contract to the detriment of the consumer.

MADDE 17 · Taksitle satış sözleşmeleri

(1) Taksitle satış sözleşmesi, satıcı veya sağlayıcının malın teslimi veya hizmetin ifasını üstlendiği, tüketicinin de bedeli kısım kısım ödediği sözleşmelerdir.

(2) Tüketicinin, kira süresi sonunda bir malın mülkiyetini edinme zorunluluğunun bulunduğu finansal kiralama sözleşmeleri hakkında da bu Bölüm hükümleri uygulanır.

(3) Taksitle satış sözleşmesi yazılı olarak kurulmadıkça geçerli olmaz. Geçerli bir sözleşme yapmamış olan satıcı veya sağlayıcı, sonradan sözleşmenin geçersizliğini tüketicinin aleyhine olacak şekilde ileri süremez.
