The debts and expenses listed below shall be deducted from the values, or from the total value, of the property acquired, provided that they are shown in the tax return.
a) In transfers occurring by way of inheritance, the debts of the deceased based on documents admissible as evidence, and tax debts;
b) In acquisitions occurring otherwise, debts relating to the transferred property itself, and tax debts (however, where the donor has assumed the debts relating to the gifted property or has so undertaken, such debts shall not be taken into account);
c) Debts relating to property located in foreign countries out of the property belonging to persons of the nationality of the Republic of Türkiye, and Inheritance and Transfer taxes levied in foreign countries in respect of such property (provided that they are documented);
ç) The debts listed in the paragraph and the Inheritance and Transfer taxes may not exceed the value of such property shown in the tax return.)
d) Expenses incurred for the preparation and burial of the deceased.

MADDE 12
İktisabedilen malların değerlerinden veya değerleri yekünundan aşağıda yazılı borçlar ve masraflar, beyannamede gösterilmek şartiyle tenzil olunur.
a) Veraset yoliyle vukubulan intikallerde murisin ihticaca salih vesaika müstenit borçları ile vergi borçları;
b) Diğer suretle iktisaplarda intikal eden malın aynına taallük eden borçlarla vergi borçları (Şu kadar ki, hibe eden hibe ettiği mala taallük eden borçları kendi üzerine almış veya öyle taahhüdetmiş ise bu borçlar nazara alınmaz);
c) Türkiye Cumhuriyeti tabiiyetinde olan şahıslara ait mallardan yabancı memleketlerde bulunanlara taallük eden borçlar ve yabancı memleketlerde bu mallar dolayısiyle alınan Veraset ve İntikal vergileri (Tevsik edilmek şartiyle);
ç) Fıkrasında yazılı borçlar ile Veraset ve İntikal vergileri, beyannamede gösterilen bu kabil malların değerini geçemez.)
d) Cenazenin techiz ve tedfini için yapılan masraflar.
