Article 22: Competence to make administrative sanction decisions

Part One: General Provisions › Chapter Four: Decision-Making Competence and Legal Remedies

(1) The administrative boards, authorities or public officials expressly designated in the relevant law are competent to make an administrative sanction decision for a misdemeanour.

(2) In cases not expressly provided by law, the highest superior of the relevant public institution or organisation is competent in this regard.

(3) Administrative boards, authorities or public officials are competent to make administrative sanction decisions only for misdemeanours committed in places falling within the area of duty of the relevant public institution or organisation.

(4) The rules on territorial jurisdiction of the Code of Criminal Procedure No. 5271 dated 4.12.2004 shall also apply to misdemeanours.

MADDE 22 · İdarî yaptırım kararı verme yetkisi

(1) Kabahat dolayısıyla idarî yaptırım kararı vermeye ilgili kanunda açıkça gösterilen idarî kurul, makam veya kamu görevlileri yetkilidir.

(2) Kanunda açık hüküm bulunmayan hallerde ilgili kamu kurum ve kuruluşunun en üst amiri bu konuda yetkilidir.

(3) İdarî kurul, makam veya kamu görevlileri, ancak ilgili kamu kurum ve kuruluşunun görev alanına giren yerlerde işlenen kabahatler dolayısıyla idarî yaptırım kararı vermeye yetkilidir.

(4) 4.12.2004 tarihli ve 5271 sayılı Ceza Muhakemesi Kanununun yer bakımından yetki kuralları kabahatler açısından da geçerlidir.
