Article 388: a. Public notice

Book Two: FAMILY LAW › Part Two: KINSHIP › Chapter Two: THE FAMILY › Division Three: FAMILY PROPERTY

Creditors and persons whose rights are likely to be impaired by the establishment of the family homestead shall, before the establishment, be called upon by a public notice made by the court to notify their objections within two months.

The situation shall additionally be notified to those whose receivables are secured by a mortgage on immovable property and to creditors holding an attachment.

MADDE 388 · a. İlân

Alacaklılar ve aile yurdu kurulması yüzünden haklarının zedelenmesi ihtimali bulunan kişiler, kuruluştan önce mahkemece yapılan ilânla itirazlarını iki ay içinde bildirmeye çağrılırlar.

Durum, alacakları taşınmaz rehniyle güvenceye bağlanmış olanlara ve hacizli alacaklılara ayrıca bildirilir.
