Article 566: b. Obligation of restitution

Book Three: LAW OF SUCCESSION › Part One: HEIRS › Chapter Two: DISPOSITIONS UPON DEATH › Division Six: ANNULMENT AND REDUCTION OF DISPOSITIONS MORTIS CAUSA A. Action for annulment

A person to whom a benefit subject to reduction has been made shall, if in good faith, be obliged to return only what remains of the benefit in his hands at the time of devolution of the estate; if not in good faith, he shall be liable in accordance with the provisions on the obligation of restitution of a possessor not in good faith.

A person whose benefit obtained by a contract of inheritance is subjected to reduction may request the return, in the proportion of the reduction, of the consideration he gave the testator for that benefit.

MADDE 566 · b. Geri verme borcu

Kendisine tenkise tâbi bir kazandırma yapılmış olan kimse iyiniyetli ise, sadece mirasın geçmesi anında kazandırmadan elinde kalanı geri vermekle yükümlüdür; iyiniyetli değilse, iyiniyetli olmayan zilyedin geri verme borcuna ilişkin hükümlere göre sorumlu olur.

Miras sözleşmesiyle elde ettiği kazandırma tenkise tâbi tutulan kimse, bu kazandırma için mirasbırakana verdiği karşılığın tenkis oranında geri verilmesini isteyebilir.
