Article 302: Dismissal of the request for appeal on points of law on the merits or reversal of the judgment

Book Six: Legal Remedies › Part Two: Ordinary Legal Remedies › Chapter Three: Appeal on Points of Law

(1) Where the Court of Cassation finds the appealed judgment of the regional court of appeal to be lawful, it shall decide to dismiss the request for appeal on points of law on the merits.

(2) The Court of Cassation shall reverse the appealed judgment on account of instances of unlawfulness that are stated in the application for appeal on points of law and are capable of affecting the judgment. The grounds for reversal shall be stated separately in the written judgment (ilâm).

(3) Where the judgment is reversed on the grounds stated in the petition for appeal on points of law, all other instances of unlawfulness established shall also be stated in the written judgment, even if they were not explained in the petition.

(4) If the unlawfulness causing the reversal of the judgment arises from proceedings established as the basis of that judgment, those proceedings shall also be reversed at the same time.

(5) The provisions of Article 289 are reserved.

MADDE 302 · Temyiz isteminin esastan reddi veya hükmün bozulması

(1) Bölge adliye mahkemesinin temyiz olunan hükmünün Yargıtayca hukuka uygun bulunması hâlinde temyiz isteminin esastan reddine karar verilir.

(2) Yargıtay, temyiz edilen hükmü, temyiz başvurusunda gösterilen, hükmü etkileyecek nitelikteki hukuka aykırılıklar nedeniyle bozar. Bozma sebepleri ilâmda ayrı ayrı gösterilir.

(3) Hüküm, temyiz dilekçesinde gösterilen sebeplerle bozulduğunda, dilekçede açıklanmış olmasa bile saptanan bütün diğer hukuka aykırılık hâlleri de ilâmda gösterilir.

(4) Hükmün bozulmasına neden olan hukuka aykırılık, bu hükme esas olarak saptanan işlemlerden kaynaklanmış ise, bunlar da aynı zamanda bozulur.

(5) 289 uncu madde hükümleri saklıdır.
