(1) Reopening of the proceedings may not be accepted for the purpose of altering the penalty within the limits provided in the same article of the law.
(2) If there is another remedy capable of correcting the error, recourse may not be had to reopening of the proceedings.

MADDE 315 · Yargılamanın yenilenmesinin kabul edilmeyeceği hâl
(1) Kanunun aynı maddesinde yer almış sınır içinde olmak üzere cezanın değiştirilmesi amacıyla yargılamanın yenilenmesi kabul edilemez.
(2) Hatanın giderilebilmesini sağlayacak başka bir yol varsa, yargılamanın yenilenmesi yoluna gidilemez.
