Article 320: Collection of evidence

Book Six: Legal Remedies › Part Three: Extraordinary Legal Remedies › Chapter Three: Reopening of the Proceedings

(1) If the court finds the request for reopening of the proceedings justified, it may assign a delegated judge or a court acting under letters rogatory to collect the evidence, or it may carry out these matters itself.

(2) The provisions relating to the investigation shall apply during the collection of evidence by the court, by the delegated judge or by way of letters rogatory.

(3) After the collection of evidence has been completed, the public prosecutor and the person against whom the judgment was rendered shall be requested to submit their opinions and observations within a period of two weeks.

MADDE 320 · Delillerin toplanması

(1) Mahkeme, yargılamanın yenilenmesi istemini yerinde bulursa delillerin toplanması için bir naip hâkimi veya istinabe olunan mahkemeyi görevlendirebileceği gibi; kendisi de bu hususları yerine getirebilir.

(2) Delillerin mahkemece veya naip hâkim tarafından veya istinabe suretiyle toplanması sırasında, soruşturmaya ilişkin hükümler uygulanır.

(3) Delillerin toplanması bittikten sonra Cumhuriyet savcısı ve hakkında hüküm kurulmuş olan kişiden iki haftalık süre içinde görüş ve düşüncelerini bildirmeleri istenir.
