Article 322: Examination of a request for reopening without a hearing

Book Six: Legal Remedies › Part Three: Extraordinary Legal Remedies › Chapter Three: Reopening of the Proceedings

(1) If the convict has died, the court shall, without holding a new hearing and after collecting the necessary evidence, decide on the acquittal of the convict or the rejection of the request for reopening of the proceedings.

(2) In other cases as well, if there is sufficient evidence on this matter, the court shall, after obtaining the concurring opinion of the public prosecutor, immediately decide on the acquittal of the convict without holding a hearing.

(3) Together with the acquittal decision, the court shall also order the setting aside of the previous judgment.

(4) If the person who requested reopening of the proceedings so wishes, the decision on the annulment of the previous judgment shall be published in the Official Gazette, the cost being borne by the State Treasury, and may also be published in other newspapers at the discretion of the court.

MADDE 322 · Duruşma yapılmaksızın yenileme isteminin incelenmesi

(1) Hükümlü ölmüşse mahkeme yeniden duruşma yapmaksızın gerekli delilleri topladıktan sonra hükümlünün beraatine veya yargılamanın yenilenmesi isteminin reddine karar verir.

(2) Diğer hâllerde de mahkeme, bu hususta yeterli delil varsa Cumhuriyet savcısının uygun görüşünü aldıktan sonra duruşma yapmaksızın hükümlünün derhâl beraatine karar verir.

(3) Mahkeme beraat kararı ile beraber önceki hükmün ortadan kaldırılmasını da karar altına alır.

(4) Yargılamanın yenilenmesi isteminde bulunan kimse isterse, gideri Devlet Hazinesine ait olmak üzere önceki hükmün iptaline ilişkin karar Resmî Gazete ile ilân olunacağı gibi mahkemenin takdirine göre diğer gazetelerle de ilân edilebilir.
