Article 241: 2. Conditions and effects

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Three: Sale of Immovable Property and Rights Giving Rise to a Sales Relationship

The seller or the buyer shall be obliged to notify the holder of the right of pre-emption, through a notary public, of the conclusion and content of the sales contract.

If, after the right of pre-emption has been exercised, the sales contract is cancelled or is not approved for reasons relating to the person of the buyer, this may not be asserted against the holder of the right of pre-emption.

Unless otherwise provided in the contract creating the right of pre-emption, the holder of the right of pre-emption shall acquire the immovable property on the terms of sale agreed between the seller and the third party.

The above provisions shall also apply to transactions economically equivalent to a sale.

MADDE 241 · 2. Koşulları ve hükümleri

Satıcı veya alıcı, satış sözleşmesinin yapıldığını ve içeriğini önalım hakkı sahibine noter aracılığıyla bildirmek zorundadır.

Önalım hakkı kullanıldıktan sonra satış sözleşmesi ortadan kaldırılırsa ya da alıcının şahsından kaynaklanan sebeplerle onaylanmazsa, bu durum önalım hakkı sahibine karşı ileri sürülemez.

Önalım hakkını kuran sözleşmede aksi öngörülmemişse, önalım hakkı sahibi taşınmazı, satıcının üçüncü kişiyle kararlaştırdığı satışa ilişkin koşullarla kazanır.

Ekonomik bakımdan satışa eşdeğer işlemlerde de yukarıdaki hükümler uygulanır.
