Article 233: II. Determination of the sale price

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

If the buyer has definitively stated that the buyer will purchase the goods without specifying the sale price, the sale shall be deemed to have been concluded at the average market price at the place and time of performance.

Where the sale price is calculated according to the weight of the object sold, the tare shall be deducted.

Commercial usages under which, in the sale of certain commercial goods, a deduction is made from the gross weight as a fixed quantity or as a percentage, or the price is determined on the basis of the gross weight, are reserved.

MADDE 233 · II. Satış bedelinin belirlenmesi

Alıcı, satış bedelini belirtmeksizin, malı alacağını kesin olarak bildirmişse satış, ifa yeri ve zamanındaki ortalama piyasa fiyatı üzerinden yapılmış sayılır.

Satış bedeli, satılanın ağırlığına göre hesaplanıyorsa, darası indirilir.

Bazı ticari malların satışında, daralı ağırlıktan miktar olarak ya da yüzde hesabıyla bir indirim yapılmasına veya bedelin, daralı ağırlık üzerinden belirlenmesine ilişkin ticari teamüller saklıdır.
