Article 222: 3. Defects known to the buyer

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

The seller shall not be liable for defects known to the buyer at the time the sales contract was concluded.

The seller shall be liable for defects that the buyer could have discovered by sufficiently examining the object sold only if the seller has expressly undertaken that no such defect exists.

MADDE 222 · 3. Alıcının bildiği ayıplar

Satıcı, satış sözleşmesinin kurulduğu sırada alıcı tarafından bilinen ayıplardan sorumlu değildir.

Satıcı, alıcının satılanı yeterince gözden geçirmekle görebileceği ayıplardan da, ancak böyle bir ayıbın bulunmadığını ayrıca üstlenmişse sorumlu olur.
