Article 214: 1. Subject matter

Part Two: Special Obligational Relationships › Chapter One: Contract of Sale › Division Two: Sale of Movable Property

If the whole or part of the object sold is taken from the buyer by a third party by virtue of a right that existed at the time the sales contract was concluded, the seller shall be liable to the buyer therefor.

If the buyer knew of the risk of eviction at the time the contract was concluded, the seller shall not be liable therefor unless the seller has expressly undertaken such liability.

If the seller has concealed the right of the third party, any agreement made to exclude or limit the seller's liability shall be absolutely null and void.

MADDE 214 · 1. Konusu

Satış sözleşmesinin kurulduğu sırada var olan bir hak dolayısıyla, satılanın tamamı veya bir kısmı bir üçüncü kişi tarafından alıcının elinden alınırsa satıcı, bundan dolayı alıcıya karşı sorumlu olur.

Alıcı, elinden alınma tehlikesini sözleşmenin kurulduğu sırada biliyor idiyse satıcı, ayrıca üstlenmiş olmadıkça bundan dolayı sorumlu olmaz.

Satıcı, üçüncü kişinin hakkını gizlemişse, sorumluluğunu kaldırma veya sınırlama konusunda yapılmış olan anlaşma kesin olarak hükümsüzdür.
